RLudlowe
The verdict reaffirms that Internet companies do not have to actively filter their sites for trademarked material. Rather, they can rely on intellectual property holders to monitor their sites, as long as they promptly remove material when rights holders complain. http://www.nytimes.com/2008/07/15/technolo...hoo&emc=rss
flex
If tiffany had presented this case in france court, it would have been ruled completely different. I bet the tiffany's NY attorneies were very cocky and thought they could have gotten more $ in the US court

The question is however, will they ever collect? Isn't ebay only bound by US law since it is a US company? Would they even have to pay that and would LV have any way of collecting? I know the US tries to enforce it's laws world wide. They have arrested several owners of internet gambling companies for operating totally legitimate companies. I don't know French law, but I'm guessing that they could be enjoined from conducting business in France (i.e., eBay.fr could be shut down). This wouldn't prevent anyone from purchasing from eBay in other countries, but it would put a damper on their overall business.
