FxrAndy Posted August 13, 2013 Report Posted August 13, 2013 I think it is the crown guard that is trade marked, different laws than patented as it never runs out as far as I know, but I don't think the shape of the case is.

Panerai's crown guard is trademarked (although I didn't check to see if it was still valid). The test for trademark infringement is "market confusion." This means would a purchaser be confused as to the origin of the goods. Homages may fall under this test and PAM could likely go after them if it wished.
