fitmic
Aren't Panerai cases copyrighted? Are the Marina Militaires legal in that perspective?
FxrAndy
I think it is the crown guard that is trade marked, different laws than patented as it never runs out as far as I know, but I don't think the shape of the case is.
fitmic
What if the crown guard has a different shape of let's say one mm, is it okay then?
FxrAndy
That is a question for a Trade Mark Lawyer
markiemark
It needs to differ by 11%
imajedi
It needs to differ by 11% Thats completely wrong. Panerai's crown guard is trademarked (although I didn't check to see if it was still valid). The test for trademark infringement is "market confusion." This means would a purchaser be confused as to the origin of the goods. Homages may fall under this test and PAM could likely go after them if it wished.
