Selling Replica Items on eBay as Aftermarket. Why is that legal?

I've seen so many sellers getting away with selling replica crap by simply calling it "aftermarket." How can this be legal? Why is it that a set of "aftermarket" Panerai hands is allowed to be sold on eBay? Or, they simply state that the item is "refinished."

the trademarking has to be on the item itself. You can say that it's "for a panerai or rolex" and it's still legal.

if there are no trademark (brand names, patented items, etc.) you really can't prevent it.

If there is no branding / trademark, it is fair game. Also, on certain items, when the patent expires like on a bezel insert, etc, it is fair game as long as there are no brand name/logo's involved.

Depends on the country you're in. If you live in Germany you will get into trouble using such descriptions!

We were made to rename Panerai aftermarket parts and tools to suit as "Pan" on our website, yet we have not been forced to do so by any other manufacturer.

Guess it was just a case of "the wrong time of the month" for Panerai!

I recently saw an "Italian made" aftermarket "new Rolex SEL jubilee style" bracelet for sale on the bay and sold. It was definitely from one of our factories, but I liked the made in Italy reference.
