racist attitude? i dont need YOU to tell me what kind if attitude i have, definitely I'm not a fuckin racist. You seem to have some sort of problem when it comes to funny things. I dont need all this "you are warned!!!" bs from YOU. My comment was neither racist nor offensive. if you think otherwise, you have a sensitivity problem or you just need a reason to pick on me. It's no different from calling it funny when a jewish person is a lawyer than when a german wears lederhosen. Whenever Johny said this quote Entourage, NOONE called him a fuckin racist, because it is NOT FUCKIN RACIST. If I had posted a picture of me wearing lederhosen, and ANYONE would have been like "funny that you are german" - NO that would NOT have been racists in your opinion. For all those that were convinced Apple didn't have a leg to stand on in the trademark battle over the name iPhone, maybe you should read this:

"An investigation into the ongoing trademark dispute between Cisco and Apple over the name "iPhone" appears to show that Cisco does not own the mark as claimed in their recent lawsuit. This is based on publicly available information from the US Patent and Trademark office, as well as public reviews of Cisco products over the past

year. The trademark was apparently abandoned in late 2005/early 2006 because Cisco was not using it."

I think google reader changed my life when they came out with the new version... so much less time wasted for dabblers like myself. I'm sure you are still probably more up-to-date though ;)

I'll be switching to RSS when the only computer I use is my own (ie. Once I move to Scotland and go freelance) and when Apple add RSS to Mail.app (in Leopard, from what we hear). I'm not a fan of putting everything on http://www.google.com/ig just yet, so I need a single computer to do it on. :D

I am curious to try the RSS in mail.app; I found the limited functionality of safari... lacking. Ended up using google reader since I can access it from every computer.... I gave up a long time ago; google has my life in it.

I have no @#%#$# clue why steve jobs is going to yahoo for email; I would be much happier if they would let .Mac die, embrace google, and integrate everything with google. If they would beef up .Mac with decent storage I would buy it for that - the 30 GB rumor was too good to be true :(

Well, clearly thats what apple lawyers told jobs - i.e. they don't have a case to stand on .

i wonder how fired the person responcible for renewing the IPhone mark is.

By the way - the Registration of the mark only creates a rebuttable presumption that there is a trademark in existance.

Problem is, even if their registration is cancelled, it does not mean that they don't have a trademark right. They still have been offering a product under that name and have trademark rights

Not continuously for the last six years. Did you see the photo they tried to renew their Trademark with after they started negotiating with Apple?

But, lets forget about any of that. If i started selling a product called iphone in 2005 (before apple offered one) then, i have trademark rights in Iphone in the US anywhere i sell/ market the product.

So, even if the registration is cancelled, they still have a case because they had a real product out and advertised in 2005. If Apple's been working on this phone for 3 yrs. they should have made a registration then, once cisco's was cancelled, then apple's would have been superior and win. :)

Do i think this is al about cisco getting a "cut" of Apple's iphone? yes, do i think that cisco has legitamit rights to the name - i think Apple threw the whole thing out on the table and said - Sue me, I dare you, :)

Now, you're assuming that this was Cisco's Trademark in the first place. It wasn't, it was a trademark of a company Linksys bought and then Cisco bought Linksys. To defend and renew a trademark, you apparently need to show it has been in use continuously for 6 years when the renewal comes up.

Yes, but Cisco released the iPhone in December 2006, after Apple registered the trademark (under the name of Ocean Telecom Services LLC, just to be secretive) in September 2006.

Like I say, it's simply not cut and dried.

Your mixing a few things together - First cisco did own the company and therefore owned the mark to the extent that the company had trademark rights - there is no question about that.

you can establish a trademark without registering by actually using it in the market place, the rights accrue whererver you sell and market it.

So, there are 2 lines of argument that cisco makes

1. We have a registered trademark that is being enfringed upon.

2. Even if you decide our registration is defective, We have trademark rights that have developed because of our actua sale and marketing of an IPhone product which we have been doing since 2005

:) it will be a very interestign case that will never get resolved by a court. There is exposure on both sides to big legal fees :)

I don't know where you get this 2005 release date from. Apple trademarked the term iPhone in September 2006 and Cisco sensing something's up branded a Linksys phone the iPhone in December 2006 in an effort to defend an already lost trademark.

I thought i read about a product they had out for awhile. even if it was december 2006 :) Apple didn't register it and cisco was in the market :)
